The former Senator and proponent of the South's secession during the Civil War signs his name on this letter to Attorney General Henry D. Gilpin from 1859 Autograph Letter Signed: J. Wilmington, Delaware, July 8, 1859. Bayard acknowledges receipt of two checks for interest and tells him that Tom ordered the Brandy for you....

Tom was his son, 30-year-old lawyer Thomas F. Bayard, later Cleveland's Secretary of State. Earlier in his career, Bayard served as the U. He served on the boards of several railroads and is probably most well-known for leading a civil suit against Thomas Garrett, who was an iron merchant that was a stationmaster on the Underground Railroad.

Bayard represented several slave owners in court, and condemned Garrett for aiding around 10 slaves in escaping through the Underground Railroad. The case ended up nearly bankrupting Garrett, but he continued in his anti-slavery efforts despite his loss. Bayard was known for being a proponent of the South's peaceful secession, and openly opposed the civil war, abolition, and any government acts used to stop the independence of the Southern states. Eventually resigning his seat in the Senate, Bayard refused to swear an oath of loyalty to the Union, with claims that doing so would be unconstitutional. Gilpin had served as Van Buren's Attorney General (January 1840-March 1841).
